In Higbie v. United States, the United States Court of Appeals for the Federal Circuit affirmed a dismissal by the U.S. Court if Federal Claims for lack of jurisdiction under the Tucker Act in a case for alleged breach of the confidentiality provisions of a mediation agreement.
