McDermott, Will & Emery’s Astrid Spain has a take on the Federal Circuit’s recent decision against a farmer who violated Monsanto’s patent on RoundUp-proof seeds. The case is interesting from a contract perspective because the court struck down a “one size fits all” liquidated damages clause that specified damages of 120 percent of the license fee.
