Friday Frivolity: A Contract to Wear a Puffy Shirt

I don’t know why it never occurred to me to discuss this before, but this episode of Seinfeld (below) presents a novel contractual conundrum. Is one bound by an agreement if one communicated acceeptance of an offer that one did not hear?

Of course, I also wonder if this is really a contract. Jerry just seems to be wearing the shirt as a favor to Kramer’s low-talking girlfriend. She probably thinks she’s giving Jerry consideration by letting him wear the shirt, but he “doesn’t want to be a pirate.” For some reason Jerry feels bound, but I don’t see a legal obligation here.
