Breaking News: A New Substack: Dave Hoffman’s Contracts’ Empire

Today, Dave Hoffman (right) launched his Substack, Contracts’ Empire The first post delves into whether the universities that have entered into settlements with the Trump administration can use the contracts defense of economic duress to escape their obligations under those settlement agreements.

The inaugural post features the rigor and insights that we have come to expect from Professor Hoffman. He begins by exploring the puzzle of governing law and surveys the law of duress in the relevant jurisdictions. He lays out the elements of a claim of economic duress and provides the arguments for why the doctrine may or may not suffice to enable the universities to escape their obligations.

It is a promising beginning to Professor Hoffman’s new venture. I expect to follow the Substack closely and will alert readers of new posts as they surface, if I can keep up with Professor Hoffman’s output.
